The purpose of this privacy policy is to inform you about the use of your personal data by AFROSMEET. Please read it carefully. However, you will find an overview of the data collected and the purposes for which it is collected at the following link : Afrosmeet  

 

1. Definitions

 

Application: The AFROSMEET app, available on Apple's App Store and Google's Play Store.

Boost: A feature that allows Members to increase the visibility of their profile during the duration of this option's activation.

Member Characteristics: Information provided by the Member describing their profile in relation to their lifestyle and characteristics. The Member can select the information they wish to display on their profile and filter other Members appearing on the Application based on this information.

Profile Certification: A feature that allows Members to authenticate their profile photo and obtain the "Certified Profile" badge, which verifies to other Members that the face photo uploaded on their profile matches their real visual identity in motion (via video).

Account: A personal space dedicated to the Member on the Application, which they access by registering and logging into the Application. It allows the Member to access the Services. A Member can only have one Account.

Match: An event between two profiles, triggered by a Like from each profile. It indicates mutual interest and triggers a notification ("You have a Match") that allows a conversation to start.

 

AFROSMEET: LBT Synergy, a simplified joint-stock company registered in the Paris Trade and Companies Register under the number 880 737 879, and the owner and sole operator of the Application and the AFROSMEET brand.

Hello (Chat Request): A non-secret action suggested before and/or after a Like, which triggers the sending of a notification to the Member you address it to and serves as an invitation to chat with that person.

Like: An action symbolized by a heart intended to express interest. Premium Members have access to the list of Likes. Except for the first Like, this action remains secret for non-Members until a reciprocal Like is obtained.

Map: A map that allows you to find Members you have crossed paths with.

Member: A person registered on the Application.

Premium Member: A member who has subscribed to AFROSMEET Premium.

Messages and/or Voice Messages: Only Members who have had a Crush (or a FlashNote if eligible) can initiate the "Chat" action within the Application and send Messages. Messages are visible in the messaging section accessible within the Application.

Profile Photos: Profile photos that allow easy recognition of the Member. In this regard, the Member agrees to edit, at a minimum, a photo of their face in the first position where they are clearly recognizable. These two cumulative criteria constitute an essential condition for using the Services.

If the Member's face photo is not edited in the first position, it will be automatically restored to the first position by default. In the event that the Member edits multiple photos of their face, they can freely choose the order of their photos.

Crossing Point: Your recorded geographic position at the moment you crossed paths with another Member when the geolocation option is activated.

Geographic Position: Your location recorded by AFROSMEET and regularly updated when this option is activated.

Services: The set of services, paid or not, offered by AFROSMEET to facilitate virtual or real meetings between Members who have crossed paths and share mutual interest, according to the selected search criteria.

 

 

2. Data Controller

 

The data collected is processed by the company LBT Synergy, registered under the number 880 737 879 with the Paris Trade and Companies Register (RCS), whose headquarters is located at 8 rue du Sentier, 75002 Paris, France, and represented by its President, Mr. Martial LIBOUTET.

 

AFROSMEET places great importance on the protection of your personal data and respect for your privacy. This privacy policy (and any document referred to herein) is intended to inform you about how we process the personal data you provide to us and that we collect in connection with your use of the Application and Services. We invite you to read this document carefully to understand our practices regarding the processing of your personal data and to know your rights in this matter.

 

This Privacy Policy applies to all Services published by AFROSMEET that you use (excluding services provided and operated by third parties, in which case the privacy policy of those third parties applies, not these provisions).

 

3. Information We Collect

 

AFROSMEET collects and processes personal data about you when you use the AFROSMEET application or when you communicate with AFROSMEET. This includes information that you provide to us directly or data that we collect automatically.

 

To ensure the readability of our privacy policy, here is an overview of the personal data concerning you, collected and processed by AFROSMEET. You will find below this overview, details about each piece of data collected.

 

  • Mandatory Data:

3.1 Data you provide to us directly

 

When using our Services, you provide us with information, some of which may identify you. When you share this information, some of this data is visible to other Members of the Application and is therefore made public on the Application. To help you easily identify them, these pieces of information are indicated below as "Public." AFROSMEET cannot be held responsible for data disclosed and made public by a Member on AFROSMEET. On the other hand, other information is not visible to other Members and is therefore not accessible to them; this information is indicated below as "Private."

 

AFROSMEET collects and processes data related to your registration and data related to your interactions with AFROSMEET.

 

3.1.1. Data related to registration and the Member profile

 

Information necessary for registration

 

This is the basic data necessary for registration to access the Services.

These data are collected by AFROSMEET in different ways depending on the registration method you choose.

 

If you choose to sign up with your Facebook, Apple, or Google account, your data will be retrieved from these platforms to minimize formalities. By clicking the "Sign in with Facebook/Apple/Google" button, you agree that these platforms will share this data with us.

 

Alternatively, you have the option to sign up with a mobile phone number. In this case, your data will be provided directly to AFROSMEET by you.

This data pertains to your identity.

 

Depending on your registration method, some information is mandatory for the provision of the Services. If you do not provide this information, AFROSMEET will not be able to offer you the Services provided by the Application, and you will not be able to create an Account. In all cases, your first name (public), your age (public), your date of birth (private), your gender, and at least one profile photo (public) are required to register on the Application. You can then add or remove photos at any time, as long as you have added at least one profile photo containing a face. As specified in paragraph 1 "Definitions," the first profile photo must be a face photo; otherwise, one of your face photos will be automatically placed in the first position.

 

When you sign up with your phone number, your phone number is required for registration.

When you sign up via Facebook, we must retrieve your first name and age. You can also authorize Facebook to share your last name, date of birth, gender, and email address with Afrosmeet and add profile photos from your Facebook account.

When you sign up via Apple or Google, we must retrieve your first name and email address. They may also share your last name with AFROSMEET.

 

Moreover, if you refuse geolocation during registration, and therefore the collection of your location data by Afrosmeet to suggest profiles of Members you've crossed paths with, you must provide your city. This information will allow AFROSMEET to suggest profiles of Members near you.

 

Optional information to complete your profile

 

You can provide additional information to complete your profile. This information is optional and provided at your discretion and responsibility. You can complete your profile either directly on the Application and/or via Facebook Connect by synchronizing your Account with Facebook. This data includes:

 

  • Professional background and education (public): profession or studies;

 

  • Interests and habits (public): personal preferences, hobbies, musical preferences, lifestyle, Member characteristics;

 

    • Height (public):

     

    • Profile description (public): If you wish, you can share additional information about yourself in the free text field provided for this purpose, which is visible to AFROSMEET Members. Additionally, if you wish, you can also answer questions about your lifestyle (personality traits, sports, travel, type of meeting sought, etc.).

     

    Your description is a free text area, AFROSMEET does not encourage Members to share data that can be classified as sensitive with other Members or with AFROSMEET via the Application. Sensitive data refers to information that is legally classified as "sensitive" under the General Data Protection Regulation (GDPR). This includes, but is not limited to, data relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as health, sexual life, or sexual orientation ("Sensitive Data"). If a Member still chooses to share such data on their profile, this communication is deemed to have been "manifestly made public" by the Member concerned, within the meaning of the GDPR.

     

    3.1.2. Data related to interactions with AFROSMEET:

     

    When you contact customer service and support, report a problem related to our Services, report another user, request assistance, exercise your rights over your personal data, or when you participate in promotions, games, contests, surveys, provide feedback on our Services, submit testimonials, and respond to our questionnaires, AFROSMEET collects the following personal data about you, as applicable:

     

    • Data related to reports and requests made to AFROSMEET's customer service (private): date and time of the report or request, nature and reason for the report or request, data related to the reported user. Additionally, proof of identity may be requested when exercising your rights over your personal data for security and confidentiality reasons.

     

    This data is collected by AFROSMEET when you request assistance from our customer service, exercise your rights over your personal data, report a problem or another user. This information is necessary to process a report or respond to your requests. This information is also processed when a report is made about you. Indeed, AFROSMEET is legally obligated to collect reports from its Members concerning content or behavior that may violate our Terms of Use.

     

    • Data related to participation in games and contests, testimonials, and satisfaction (private): participation, responses, level of satisfaction, suggestions, testimonials.

     

    This data is collected by AFROSMEET when you participate in our games and contests, respond to our surveys and satisfaction questionnaires, provide your testimonials. This data is mandatory if you wish to participate in the games and contests organized by AFROSMEET. Without this data, AFROSMEET will not be able to register you for the games or contests. However, data related to your testimonials and satisfaction is optional.

     

    3.2 Data we collect automatically

     

    When you use our services and features, we collect information about your activity on the Application:

     

    • Data related to your activity: (registration date, login dates, your online or offline status, interactions with Members and third-party accounts, number of transactions, notifications received, notification preferences, etc.)

     

    When you access the Services and use the Application and its features, information is collected and processed regarding how you use them. Most of this information collected by AFROSMEET is necessary for the provision of Services. Without this data, AFROSMEET will not be able to provide the Services related to the AFROSMEET application.

    This includes registration date, login dates, your online or offline status, the type and number of interactions with other Members (such as FlashNotes, Hellos, Likes, crossings, and Crushes), with your third-party accounts connected to your Account (such as Spotify, Instagram), or the number of transactions made (purchases of Hellos, FlashNotes, or subscription(s)), the notifications you have received, and your notification preferences.

     

    • Geographic positions and Crossing Points with other Members (private)

     

    The Application's main interest and purpose is to allow you to find other Members you have crossed paths with or may cross paths with. Your Geographic Position is collected with your express consent. Indeed, authorization is requested to collect and process data related to your geolocation to allow AFROSMEET to identify your Crossing Points with other Members who have agreed to be geolocated.

    Unless you have made stricter settings choices on your device, your Geographic Position is regularly collected by Afrosmeet.

    When the Geographic Positions of two Members are within the same radius, a crossing is established by AFROSMEET.

    Your Crossing Points are displayed in your profile, but in no case can the Members you cross know your exact position. Indeed, each Member sees on their Application their own position at the time of the crossing within a radius defined by AFROSMEET and not the position of the other Member.

    If during your registration, you do not consent to geolocation, you must provide your city. This information will then allow AFROSMEET to suggest profiles of Members near you.

     

    These crossing points can be displayed either as a news feed or on the Map.


    You can withdraw your consent at any time by disabling the geolocation option on your smartphone. In this case, your news feed will no longer be updated, and you will no longer be able to see which other Members you have crossed paths with after disabling the geolocation option. When you no longer have profiles in your news feed, we will ask for your city to suggest new Member profiles around you.

     

    <

    You can also request that your profile, and thus your crossing points, are no longer displayed on the Map. In this case, you will only appear in the news feed of other Members. Similarly, you will no longer see the profiles of Members crossed on the Map, but only in your news feed. To do this, go to the application, click on "My Preferences," scroll to the bottom of your screen, and disable the "Share my crossing points" option.

     

    • Text messages and voice messages sent and received (private)

     

    The Messages are sent and stored on AFROSMEET's servers to ensure the Service of transmitting exchanges between Members who have had a Crush or when a Member uses the FlashNote feature. Text messages and voice messages are strictly private and are only accessible to the Members involved. Authorized AFROSMEET personnel have no oversight of these conversations. These Messages are not transmitted or communicated to third parties, except under judicial request and/or in accordance with applicable legal or regulatory provisions. Additionally, the Messages are strictly private and will not be accessible to other Members not involved in the exchange or to any third parties.

     

    • Information related to Video Calls (start and end times of the calls, etc.) (private)

     

    When you wish to make a Video Call on the AFROSMEET application, technical data from your phone is necessary to establish the communication between the two Members. The start and end times of the calls will be stored by AFROSMEET, but AFROSMEET does not store the content of the Video Calls. These Video Calls are instant.

     

    • Search preferences – people you wish to cross paths with (age, gender) (private)

     

    The Application allows you to configure the search for Members by age, gender, and the characteristics of the Member they have completed. You can modify these parameters and enter the age range, Member characteristics, and, after having previously consented to the collection and processing of this data by AFROSMEET, the gender of the people you are looking to cross paths with, to display only the profiles crossed that meet your criteria. You will then only see crossed Members in your news feed who share your search preferences.

     

    • Technical data of the mobile or device (IP address, mobile ID, application version, phone version and model, advertising identifier, etc.) (private)

     

    We collect information from and about the devices and equipment you use to access our Services, such as server logs that may include, among other things, IP addresses, application version, device version and model, mobile or device identifier, the language used, operating system, application crashes, advertising identifiers, etc.

     

    Data related to transactions: AFROSMEET does not collect or process any banking data. Apple's App Store and Google's Play Store have chosen not to share certain data with mobile applications, including data related to transactions. This data is exclusively collected and processed by these platforms, without the ability for AFROSMEET to alter this payment method. The only information exchanged between AFROSMEET and Apple's App Store or Google's Play Store concerns technical data that does not allow you to be identified (e.g., a transaction number) to validate transactions. Therefore, AFROSMEET will retain your purchase and subscription history but will not retain any information related to payment methods.

     

    4. How do we use your data?

     

    4.1 Provision of services and features in accordance with our terms of use

     

    • Creation and management of your Account as a Member:
      • Creation of your profile.
      • Registration, deregistration, deactivation of the Member's profile.
      • Management of your settings and preferences.
      • Management of subscriptions.
      • Management of access to the Services offered by AFROSMEET.

     

    • Management and storage of communications exchanged between Members (Messages, Crushes, Likes).

     

    • Management of Video Calls between Members

     

    • Management of subscriptions and paid Services subscribed to (Hellos, FlashNote, call credits, etc.)

     

    • Sending information messages related to the Services or your interactions with other Members (notifications).

     

    Legal basis: Contract execution

    The data collected by AFROSMEET is necessary for the proper functioning of the Application and the provision of the Services offered to Members under the service contract that binds us (General Terms of Use).

     

    4.2 Suggesting profiles you have crossed paths with or may cross paths with

     

    • Geolocation for the purpose of suggesting profiles of Members you have crossed paths with or may cross paths with.

 

Legal basis: Consent 

When you have given your consent, you can withdraw it at any time by disabling the geolocation option on your smartphone. The withdrawal of your consent does not affect the processing carried out before this withdrawal.

 

More info?

The Application is designed to help you find other Members you have crossed paths with or might cross paths with. It identifies crossing points with other Members who have agreed to be geolocated. These crossing points allow AFROSMEET to present you with the profiles of Members you have crossed paths with or might cross paths with, and who match your search criteria.

 

  • Depending on your activity on the Application, your location, and the information provided on your profile, your profile may be highlighted to other Members. We may also recommend other Members who might interest you via your Shortlist, those you have crossed paths with or might cross paths with, and, conversely, recommend your profile to other Members. Your profile is also highlighted when you use the Boost feature defined in paragraph 1.

 

Legal basis: Contract execution

This processing is carried out to provide you with the Services and, ultimately, maximize your chances of meeting Members who match you.

 

  • Recommend your profile by email to other Members that you have crossed paths with or might cross paths with

 

Legal basis: Legitimate interest

This processing is based on AFROSMEET's legitimate interest in offering Members relevant profiles within the framework of its Services. You can object to this use at any time by contacting us (see section 11. Contact).

 

4.3 Offer relevant offers and content (marketing and advertising)

 

  • Sending marketing or advertising messages or content:

 

    • Sending the AFROSMEET editorial newsletter by email. The newsletter will stop being sent if it has not been opened by Members for more than a year.
    • Sending a newsletter offering profile recommendations that can be viewed in the application (e.g., your Shortlist).
    • Displaying marketing and advertising content on AFROSMEET's offers and services in the application and by email.
    • Offering Members offers and/or promotions on AFROSMEET services.

 

Legal basis: Legitimate interest

This processing is based on AFROSMEET's legitimate interest in informing you about its offers. Regarding the newsletter, you can opt out at any time from receiving emails from AFROSMEET by clicking the "unsubscribe" link provided in the emails you receive.

 

  • Conduct marketing and advertising operations outside the application: we conduct marketing and advertising operations outside the AFROSMEET application on third-party sites, social networks, and third-party applications. When you are already a Member of the AFROSMEET Application, we may share your email address and phone number with these networks to exclude you from our Marketing campaigns. This information is transmitted with a "hash" function. This sharing can also allow AFROSMEET to broadcast campaigns to profiles similar to yours who might be interested in our Services. The existence of your profile will never be disclosed to these similar profiles. The social networks that may receive your data for this purpose are listed among our service providers available via this link.

 

Legal basis: Legitimate interest

This processing is based on AFROSMEET's legitimate interest in excluding you from its promotional content on social networks and promoting its service on third-party sites to non-Members. You can object to the sharing of data with these social networks by contacting us (see section 11. Contact) or directly in the application by going to "My data" then "Manage my choices." By objecting to this sharing, we will no longer be able to exclude you from our advertisements on these networks.

 

  • Display personalized advertisements on the AFROSMEET application regarding third-party products and services so that they are relevant to the Member. These advertisements are personalized only according to your age range, gender, and country or city. Your personal pr

     

    Legal basis: Consent

    The advertisements displayed on the AFROSMEET application are personalized if you have given your consent. You can withdraw your consent at any time for the personalization of advertising based on your age group and gender by going to "My data" then "Manage my choices." Premium Members do not see advertisements on the AFROSMEET application.

     

    • Displaying non-personalized advertisements on the AFROSMEET application (based solely on your country) concerning partner products and services, as well as AFROSMEET products and services.

    This processing is based on AFROSMEET's legitimate interest in displaying non-personalized advertisements on its application when a Member is not Premium.

     

    4.4 Improve and optimize our services and understanding of your usage

     

    • Improvement and optimization of AFROSMEET's services, understanding of its Members, and how the Services are used:
      • Statistical studies.
      • Satisfaction surveys.
      • Analysis of how the Application and Services are used by Members.
      • Understanding how our Application and features are used.
      • Improving the Application, our offers, and features.
      • Understanding your needs.

     

    Legal basis: Legitimate interest

    This processing is based on AFROSMEET's legitimate interest in improving and optimizing its services, understanding its users, and how its services are used.

     

    • Provide Members with advice on the photos they publish by analyzing all Members' profiles to help them optimize their profile presentation if they wish.

     

    Legal basis: Legitimate interest

    This processing is based on AFROSMEET's legitimate interest in improving the presentation of profiles on its Application. You can object to this use at any time by contacting us (see section 11. Contact).

     

    4.5 Ensure the security of your personal data

     

    • Detect or prevent security breaches in the Services by identifying and analyzing fraudulent behaviors.

     

    Legal basis: Legitimate interest

    This processing is based on AFROSMEET's legitimate interest in ensuring the security of its application and the data it processes. You can object to this use at any time by contacting us (see section 11. Contact). However, AFROSMEET may continue to implement the processing if it justifies legitimate and compelling reasons.

     

    4.6 Prevent and combat illegal or unauthorized activities (violation of the terms of use), ensure Member trust, and comply with legal requirements

     

    • Analysis and processing of reports of fraudulent/undesirable behaviors.

     

    • Management of undesirable behaviors and warnings, suspension, blocking, or deletion of the Member's Account.

     

    • Management of Members' requests to exercise their rights regarding their data.

     

    Legal basis: Legal obligation

    This processing is based on AFROSMEET's legal obligation, as a data host, to remove illegal content as soon as it becomes aware of it (Article 6 of the Law of June 21, 2004, for Confidence in the Digital Economy) and its obligation to respond to Members' requests to exercise their rights over their personal data (Articles 12 to 22 of the GDPR).

     

    • Detect or prevent fraudulent activities or those contrary to our Terms of Use:

     

      • Automated analysis of profile data and activity on the application to detect fake profiles, fraudulent behaviors, or those that violate the Terms of Use.

 

  • Ensure profile quality;

 

    • Automated analysis of Member photos to detect a face, in order to exclude fake profiles from the Application, combat fraudulent behavior, and ensure Member identification. It will be impossible to create an account if no face is detected in one of your photos during registration. If your registration is not accepted even though your photo contains a face, you can contact us at any time.

 

Legal basis: Legitimate interest

This processing is based on AFROSMEET's legitimate interest in preventing and stopping fraudulent activities that could be carried out on its Services or that violate its General Terms of Use, and ensuring user security by enabling profile identification. You can object to this use at any time by contacting us (see section 11. Contact). However, AFROSMEET may continue to implement the processing if it justifies legitimate and compelling reasons.

 

  • Profile certification (defined in paragraph 1): To certify a Member's profile, AFROSMEET must, based on the Member's consent, collect biometric data from a video of the Member's face and compare it to their Profile Photos. If the faces match, a "Certified Profile" badge will be awarded. Biometric data is immediately deleted after the comparison. The video will, however, be retained to allow for future verification of the Member's profile based on photos they add/remove. In this case, biometric data will be collected again from the same video, then deleted after comparison with the Member's new photos.

 

Legal basis: Consent

Your consent for the use of your biometric data for profile certification purposes is requested when you start the certification process. You can withdraw it at any time by going to "My data" then "Manage my choices." If you withdraw your consent, your video will be deleted, and your biometric data will no longer be collected. If you add new Profile Photos or delete your current Profile Photos, the comparison of your face will be impossible, and you may lose your "Certified Profile" badge.

 

4.7. Provide help and technical support to Members.

 

  • Respond to assistance requests made by Members regarding the use of the Application.

This processing is based on AFROSMEET's legitimate interest in allowing its Members to use the Application under good technical and operational conditions.

 

5. Cookies and trackers

 

Cookies may be used on our website for technical purposes, advertising purposes, and audience measurement purposes. On the Application, cookies and trackers may be used for technical purposes and audience measurement.

 

6. How are your data shared?

 

Only certain customer service employees and authorized AFROSMEET personnel process Members' personal data for the purposes described above. These employees and authorized personnel only have access to the data necessary for their duties.

 

Certified and reliable service providers and partners may also access and/or process Members' personal data on behalf of AFROSMEET in compliance with the Privacy Policy and ensuring the security and confidentiality of Members' personal data. These providers help us operate and improve our Services, particularly concerning:

  • Our subcontractors for our infrastructure and data hosting;
  • Our analytics software providers;
  • Our technical service providers for the use of the Application and/or the proper functioning of the Application;
  • Our customer service for providing necessary assistance to Members and managing reports;
  • Our Marketing partners to send relevant offers, messages, and content to AFROSMEET Members and non-Members.

 

As part of marketing and advertising operations outside the application aimed at non-Members, your data may be transmitted to partner social networks to exclude you from our campaigns, unless you object.

 

In addition, at the request of state bodies, including judicial authorities, and to comply with any judicial or legal request, AFROSMEET may transmit its Members' personal data.

 

Finally, we may transmit your data as part of corporate operations, such as, but not limited to, restructuring, change of control, merger, acquisition, sale, dissolution.

 

7. Data transfer outside the EU

 

The personal data of Members processed in connection with the use of the Application are hosted within the European Union.

 

However, the personal data of Members is transmitted to AFROSMEET subcontractors located outside the European Union for Member support, report management, advertising, and marketing purposes.

 

Data transfers outside the European Union may be made to countries for which there is no adequacy decision issued by the European Commission regarding personal data protection. AFROSMEET ensures that these transfers are made in conditions that guarantee the confidentiality and security of the data and an adequate level of protection in compliance with the applicable regulations. Indeed, these transfers are governed by standard contractual clauses from the European Commission. 8. How to exercise your data rights?

 

Your rights

In accordance with Law No. 78-17 of January 6, 1978, known as the French Data Protection Act, and the GDPR, each Member has the right to access, rectify, and, where applicable, the right to data portability and erasure of their personal data, as well as the right to object to processing or restrict it, and the right to set guidelines regarding the fate of their personal data after their death. Concerned about its Members' privacy, AFROSMEET is committed to respecting the protection of personal data and handling these requests as quickly as possible.

 

How to exercise them?

The Member can exercise their rights, subject to proving their identity, by sending an email to support@Afrosmeet.com, by exercising their rights directly from the Application, or by sending a letter to the following postal address: Attention Data Protection Officer, AFROSMEET - 8 rue du Sentier 75002 Paris - France. For confidentiality reasons, if there is doubt about the requester's identity, proof of identity may be required.

 

For any other complaints, the Member can submit a request to the competent national data protection authority.

 

Details of the rights

  • The right of access allows the Member to request AFROSMEET to provide them with their personal data in an accessible format under the terms and conditions of Article 15 of the GDPR. Your right of access should not infringe on the privacy of others, so you will only have access to your personal data and not that of others (for example, you can only access the messages you have sent, not those you have received).
  • The right to rectification allows the Member to request AFROSMEET to rectify, complete, update, or erase their personal data, which is inaccurate, incomplete, ambiguous, outdated, or whose use, communication, or storage is prohibited under the terms and conditions of Article 16 of the GDPR. You can modify or rectify certain data directly from the Application. Simply go to your profile and directly modify the "My Photos," "Job and Education (Position, Employer, School)," and "About Me" sections. If you registered via Facebook Connect, to modify your first name, age, or gender, go to your Facebook page and update the "About - General Information and Contact Details" section of your profile. If you registered via a mobile phone number, you must send a letter or contact customer support at the addresses indicated above to modify your first name, age, or gender. In case of an error, the age can be corrected once directly from the Application.
  • The right to data portability allows the Member to receive the personal data they have provided to AFROSMEET in a structured, commonly used, and machine-readable format and to transmit it to another data controller under the terms of Article 20 of the GDPR. 
  • The right to object allows the Member to object, free of charge and at their discretion, to their data being used by AFROSMEET for marketing purposes, particularly for commercial purposes, and to processing based on AFROSMEET's legitimate interest, under Article 38 of the Data Protection Act and Article 21 of the GDPR. For processing based on legitimate interest, AFROSMEET retains the possibility to justify compelling legitimate grounds to continue the processing. 
  • The right to erasure allows the Member to request the erasure of their data, free of charge and at their discretion, within the limits of the rights based on Article 17 of the GDPR. Additionally, you can delete your Account using the corresponding function directly on the Application. We inform you that all your data will be deleted from the AFROSMEET application. However, AFROSMEET, as a data host, is legally obliged to retain your personal data for one year under Article 6-II) of Law No. 2004-575 of June 21, 2004, on Confidence in the Digital Economy. Your data will be stored in a separate archive database from our production databases and only to respond to a judicial request. They will be permanently deleted after the one-year period.
  • The right to restriction of processing allows the Member to temporarily freeze the use of certain data by AFROSMEET under the conditions of Article 18 of the GDPR.
  • The right for the Member to define their directives regarding the retention, erasure, and communication of their personal data after their death according to Article 85 of the Data Protection Act.

 

These rights can only be exercised within the limits of AFROSMEET's capabilities in the context of using Facebook, Google, or Apple to log in to the Application. Some of the data has been provided to AFROSMEET via Facebook, Google, or Apple and can therefore only be rectified with the cooperation of Facebook, Google, or Apple.

  

9. How long do we retain your data?

 

AFROSMEET has implemented an automatic process for deleting your account and personal data, respecting the retention periods defined below. When certain data must be kept for statistical purposes beyond these periods, this data is anonymized irreversibly so that it is no longer possible to identify you.

 

AFROSMEET retains Member data for the duration necessary to use the Member's Account, meaning: 

 

  • For the duration of the Member's registration plus one year. After one year of inactivity on an Account, it will be deleted, and the Member's data will still be retained for one year before being permanently destroyed or irreversibly anonymized. An account is considered inactive when the Member's Application has not established contact with AFROSMEET's servers (particularly due to the deactivation of the geolocation option); and the Member has not used the Application. In any case, a Premium Member is not considered inactive. It should be noted that AFROSMEET, in its capacity as a data host, is legally obliged to retain certain personal data of Members for one year under Article 6, II of the Law for Confidence in the Digital Economy of June 21, 2004.
  • When a Member is banned, their account will become inactive. The banned account information is retained for one year in the active database to compare with information provided during new registrations on the Application and to prevent, as much as possible, any re-registration of an excluded user. After this period, personal data is archived and retained for an additional year before being permanently deleted or irreversibly anonymized.
  • When the Member deletes their Account or requests its deletion from customer support, it will be deleted from the Application. However, the Member's data will be retained in a separate archive database for one year before being permanently destroyed or irreversibly anonymized to allow AFROSMEET to comply with its retention obligation as a data host.
  • Certain Member data, such as email addresses and phone numbers, will be retained for prospecting or marketing purposes (see Article 4.3.) or for analysis purposes to improve and optimize the service (see Article 4.4) for one year after one year of Account inactivity. If the Member deletes their Account, the data will not be used for prospecting or marketing purposes.

 

How long are they stored?

  • Your geographical positions are stored for one month from the time they are collected to determine your Points of intersection with other Members;
  • Your Points of intersection are stored for six months from the time they are collected to display the profiles of Members you have encountered on the Application.

 

AFROSMEET is committed to using its best efforts and all available means to ensure the optimal security of the stored data. However, it is up to the Member to take appropriate measures to protect their data.

 

10. Personal Data of Minors

 

AFROSMEET refuses to collect data from minors. In case of a Member lying about their date of birth, especially through fraudulent claims of being of legal age, the parents of the minor are encouraged to notify AFROSMEET by sending an email to one of the contacts listed in section 11 "Contact" to request the deletion of the data. AFROSMEET commits to deleting all personal data concerning the minor as soon as possible.
